Who these terms are with
These terms are between you (the client) and LevelClash, trading as LevelClash, registered in New Zealand at 89 Rippingale Road, Hanmer Springs 7334, New Zealand. Contact: [email protected], +64 3 315 7429.
They apply to your use of levelclash.com and, together with our written proposal and booking confirmation, to any event we deliver. Where a signed agreement for a specific event conflicts with these terms, that agreement prevails.
What the service is
LevelClash supplies offline, adults-only casino-themed event entertainment: entertainment tables, trained hosts, event production, branding and related services, delivered at a venue you nominate.
For the avoidance of doubt, and as a defining feature of the service:
- the service is not gambling and is not a gambling or gaming service of any kind;
- no bets or wagers are accepted or placed at any point;
- chips and points are symbolic, issued free of charge, hold no monetary value, cannot be purchased, cannot be topped up for value and cannot be exchanged for money, goods or credit;
- there are no cash prizes and no payouts of money or money equivalents;
- there are no deposits and no player accounts;
- we provide no online casino services, no betting platform and no remote gaming of any kind;
- events are for adults aged 20+ and over only.
Where you choose to recognise a guest or team at the end of an event, any trophy or gift is supplied by you, is not funded by guests and is not a payout tied to the value of symbolic chips.
Enquiries, proposals and booking
Information on this website and in any indicative discussion is an invitation to enquire, not an offer. A booking exists only when:
- we have issued a written proposal for your event, and
- you have accepted it in writing, and
- we have confirmed the booking in writing, including date, venue, scope, crew and the agreed fee.
Dates are held only once confirmed in writing. We may decline an enquiry, including where the venue is unsuitable, where the requested use would conflict with the nature of the service set out above, or where we cannot resource the date.
Fees and payment
We do not publish prices. Every event is quoted individually, because the fee depends on the size of the event, the venue, travel, the formats chosen and the scope of production and branding.
Payment terms are set out in the proposal and booking confirmation for your event, and typically cover a deposit to secure the date, the balance due before or shortly after the event, and how travel, accommodation and any venue charges are treated. Any applicable taxes are stated in the proposal. Branded items are produced only after written sign-off of the proof and are charged whether or not the event proceeds.
Changes, postponement and cancellation
Change and cancellation terms are confirmed in writing with your booking, so you know the position before committing. In outline:
- Changes to date, venue, guest numbers or scope are accommodated where crew and kit allow, and may change the fee.
- Postponement to a new date is usually possible where we have availability, with the deposit carried across.
- Cancellation by you may incur a charge on a sliding scale by notice given, plus the cost of any branded items already produced and any committed third-party costs.
- Cancellation by us, which we avoid other than in exceptional circumstances, means a full refund of amounts paid for the cancelled event, and we will help you find an alternative supplier where we can.
Your responsibilities as client
So that we can deliver safely and on time, you agree to:
- ensure the venue is available for the agreed load-in, event and strip-out windows, with a usable access route and sufficient power;
- provide accurate information about access, stairs, lifts, floor surfaces, power and venue restrictions;
- obtain any permissions or licences the venue or local authority requires in connection with your event (other than those relating to our own equipment and crew);
- ensure that only guests aged 20+ and over take part at the tables;
- not request, encourage or permit any form of wagering, staking, cash handling or payout in connection with our tables, hosts or equipment;
- be responsible for the conduct of your guests, and for loss or damage to our equipment caused by them beyond fair wear and tear;
- tell us promptly about anything that could affect delivery, including a change of venue or a significant change in guest numbers.
Our hosts may suspend or close a table where conduct becomes unsafe, where a guest appears to be under age, or where there is pressure to depart from the no-wagering position. We will always try to resolve this with your event contact first.
Our responsibilities
We will deliver the agreed scope with reasonable skill and care, arrive within the agreed window, staff tables as set out in the proposal, comply with venue rules, and leave the venue clear at the end of the event. Where a specific item of equipment becomes unavailable we may substitute an equivalent of the same or better standard.
Media and confidentiality
We photograph our own set-ups for portfolio use, before guests arrive unless you agree otherwise. We will not publish images that identify your guests, your organisation or a private venue without written permission, and we will not photograph at all if you ask us not to. We will sign a confidentiality undertaking on request, and our crew are briefed not to discuss private events.
Website use and intellectual property
Content on levelclash.com, including text, images, layout and brand assets, belongs to LevelClash or its licensors. You may view, share and print pages for your own, non-commercial purposes. You may not copy the site for a competing service, scrape it at scale, or use our name or marks in a way that suggests endorsement.
You agree not to misuse the website, including by attempting unauthorised access, introducing malicious code, or using the enquiry form to send unsolicited commercial messages.
Limitations and liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, including rights you may have under consumer legislation in New Zealand.
Subject to that: we are not liable for indirect or consequential loss, loss of profit, loss of anticipated savings or reputational loss; our total liability in connection with an event is limited to the fee paid for that event; and we are not liable for failures caused by matters outside our control, including venue restrictions imposed late, inaccurate information provided to us, or the acts of your guests or other suppliers.
Information on this website is provided in good faith for general guidance. Indicative guest numbers, timings and space requirements are planning estimates, not guarantees, and are confirmed for your event in the proposal.
Force majeure
Neither party is in breach for a delay or failure caused by an event beyond its reasonable control, including natural events, earthquake, severe weather, fire, flood, epidemic or public health restrictions, failure of utilities, transport disruption, industrial action or government action. We will tell you as soon as we can, work with you to reschedule, and where rescheduling is impossible we will refund amounts paid for the affected event less committed third-party and production costs.
Governing law and disputes
These terms, and any dispute arising from them or from an event, are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not remove protections you have under the mandatory law of your place of residence.
Before any formal step, please contact us at [email protected]. Most issues are resolved with a conversation and a revised run sheet.
Changes to these terms
We may update these terms. The version that applies to your event is the one in force when your booking is confirmed. The date at the top of this page shows the current version.
Informational template
This document is provided for information and transparency. It is drafted as a template for LevelClash and should be reviewed by a qualified lawyer in New Zealand before being relied on, and updated whenever our processing, suppliers or services change.
